1. 1. Who we are

   GetModels.AI is provided by BuildAndBuild OÜ, Sepapaja tn 6, 11415 Tallinn, Estonia, registry code 17378955 ("we", "us"). You can reach us at contact@getmodels.ai. These terms apply to everyone who uses getmodels.ai ("the service").

2. 2. Your account

   • You must be at least 18 years old, or use the service on behalf of a business.
   • Keep your sign-in details safe. You're responsible for what happens in your account.
   • Give us accurate information, and keep your email address up to date.

3. 3. What the service does

   GetModels.AI uses artificial intelligence to create images of synthetic models wearing the garments you upload or link to. The people shown in generated images are not real people.

   AI results vary. We work hard on quality, but we can't guarantee that every image will match your garment or expectations exactly. You can create more images or retry a failed campaign at any time.

4. 4. Pro membership and payment

   • We offer monthly memberships (Pro and Max). Current prices are shown on the pricing page and at checkout. Prices are in euros; any VAT that applies is shown at checkout.
   • You pay in advance for each billing month. Your membership renews automatically every month until you cancel.
   • You can cancel at any time. Cancelling stops the next renewal; you keep access until the end of the month you've paid for. Payments already made aren't refunded, except where the law requires it.
   • Payments are processed by Stripe. We never see or store your full card details.
   • If we change the price, we'll tell you by email at least 30 days before it applies to you. You can cancel before then.
   • If you switch from Pro to Max, your new billing month starts that day. You're charged the Max price minus the unused part of your current month, and your credit balance is reset to the Max allowance.

5. 5. Credits

   • Pro includes 750 credits and Max includes 4,000 credits per billing month, plus any top-ups you've added. One generated image uses 10 credits.
   • Credits reset at the start of each billing month. Unused credits don't carry over to the next month.
   • If an image can't be generated, the credits for it are returned to your balance automatically.
   • Credits have no cash value and can't be transferred, sold or exchanged for money.

6. 6. Credit top-ups

   While you have a membership, you can add 750 credits for €25. The credits are added right away and you're charged €25 immediately. Each top-up also adds one block to your membership, so every following month includes the extra 750 credits and is billed at the larger amount. To reduce your plan again, contact us at contact@getmodels.ai before your next renewal.

7. 7. Right of withdrawal (EU consumers)

   If you're a consumer in the EU, you normally have 14 days to withdraw from an online purchase. Because credits are digital content that we provide immediately, we can only start once you ask us to.

   By clicking a purchase button, you ask for your credits to be made available right away and acknowledge that you lose your right of withdrawal once they are. This is stated next to every purchase button, and we record the time of your purchase. This doesn't affect your other legal rights, for example if the service doesn't work as described.

8. 8. Your uploads

   You keep all rights to the photos and product links you upload. You give us permission to store and process them only to provide the service to you.

   You confirm that you have the right to use everything you upload, for example because the garments and photos are yours or you have permission from their owner.

9. 9. Generated images

   As between you and us, you may use the images you generate for any lawful purpose, including commercial use such as your online store, ads and social media. We transfer to you any rights we may have in them.

   Please keep in mind that AI-generated images may not be protected by copyright in every country, and that other users may get similar results.

   Don't use generated images to mislead people, for example by presenting a synthetic model as a real person or as a real customer. Where the law requires it (such as the EU AI Act), label images as AI-generated.

10. 10. Acceptable use

    You agree not to use the service to:

    • create sexual, violent, hateful or otherwise illegal content;
    • create images that look like a real, identifiable person without their consent;
    • infringe anyone's copyright, trademark or other rights;
    • interfere with the service, get around usage limits, or access it by automated means we haven't approved.

    We may suspend or close accounts that break these rules.

11. 11. Availability and changes

    We aim to keep the service available at all times, but there may be interruptions for maintenance or reasons outside our control. We may improve or change features over time.

12. 12. Liability

    Nothing in these terms limits our liability where the law doesn't allow it, including for intent, gross negligence, or harm to life, body or health. If you're a consumer, your statutory rights are not affected.

    Otherwise, our total liability to business customers is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect losses such as lost profits.

13. 13. Ending the agreement

    You can stop using the service and cancel your membership at any time. To delete your account and data, email us at contact@getmodels.ai. We may end the agreement with 30 days' notice, or immediately if you seriously break these terms.

14. 14. Changes to these terms

    We may update these terms. If a change affects you materially, we'll email you at least 30 days before it takes effect. If you don't agree, you can cancel before then.

15. 15. Governing law

    These terms are governed by the laws of Estonia. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. EU consumers can also turn to the Estonian Consumer Disputes Committee. More details are in our legal notice.
